Apesar da atualidade desse debate, a constituição brasileira de 1988 apresenta em diversas normas, a proteção do meio ambiente e a defesa do desenvolvimento sustentável como valor constitucional. A presente pesquisa em desenvolvimento tem como propósito demonstrar por meio da interpretação das concepções filosóficas a influência de Gustav Radbruch tendo como ponto de partida o direito das obrigações. Por meio da análise da obra Filosofia do Direito, entende-se a perpetuação do autor como uma ponte para a compreensão dos conceitos de personalidade, propriedade e contrato, tendo como fundamento sempre as bases do direito alemão.

This article aims to review the standard objections to dualism and to argue that will either fail to convince someone committed to dualism or are flawed on independent grounds. I begin by presenting the taxonomy of metaphysical positions on concrete particulars as they relate to the dispute between materialists and dualists, and in particular substance dualism is defined. In the first section, several kinds of substance dualism are distinguished and the relevant varieties of this kind of dualism are selected. The (...) remaining sections are analyses of the standard objections to substance dualism : It is uninformative, has troubles accounting for soul individuation, causal pairing and interaction, violates laws of physics, is made implausible by the development of neuroscience and it postulates entities beyond necessity. The COVID-19 pandemic has brought significant challenges to healthcare systems worldwide, and in Africa, given the lack of resources, they are likely to be even more acute. The usefulness of Traditional African Healers in helping to mitigate the effects of pandemic has been neglected. We argue from an ethical perspective that these healers can and should have an important role in informing and guiding local communities in Africa on how to prevent the spread of COVID-19. Particularly, we argue not only (...) that much of the philosophy underlying Traditional African Medicine is adequate and compatible with preventive measures for COVID-19, but also that Traditional African Healers have some unique cultural capital for influencing and enforcing such preventive measures. The paper therefore suggests that not only given the cultural context of Africa where Traditional African Healers have a special role, but also because of the normative strength of the Afro-communitarian philosophy that informs it, there are good ethical reasons to endorse policies that involve Traditional Healers in the fight against COVID-19. We also maintain that concerns about Traditional African Healers objectionably violating patient confidentiality or being paternalistic are much weaker in the face of COVID-19. (shrink)

Translation of Aristotle's Physics I-II into Portuguese, with commentaries. Tradução para o português dos livros I e II da Física de Aristóteles, com comentários.

Gottfried Leibniz embarked on a research program to prove all the Aristotelic categorical syllogisms by diagrammatic and algebraic methods. He succeeded in proving them by means of Euler diagrams, but didn’t produce a manuscript with their algebraic proofs. We demonstrate how key excerpts scattered across various Leibniz’s drafts on logic contained sufficient ingredients to prove them by an algebraic method –which we call the Leibniz-Cayley (LC) system– without having to make use of the more expressive and complex machinery of first-order (...) quantificational logic. In addition, we prove the classic categorical syllogisms again by a relational method –which we call the McColl-Ladd (ML) system– employing categorical relations studied by Hugh McColl and Christine Ladd. Finally, we show the connection of ML and LC with Boolean algebra, proving that ML is a consequence of LC, and that LC is a consequence of the Boolean lattice axioms, thus establishing Leibniz’s historical priority over George Boole in characterizing and applying (a sufficient fragment of) Boolean algebra to effectively tackle categorical syllogistic. Resumo Embora controversa, o contextualismo epistêmico alega oferecer a melhor explicação para alguns fenômenos analisados em epistemologia contemporânea, por exemplo: alega responder ou explicar o apelo de certos paradoxos e, ao mesmo tempo, manter a verdade de nossas alegações ordinárias de conhecimento. Conforme alegado por contextualistas, a vantagem de sua teoria ao explicar o apelo de certos paradoxos reside no fato de que nenhum princípio lógico precisa ser rejeitado. O paradoxo do prefácio – que consiste na aparente incoerência lógica que (...) ocorre quando o autor de um livro declara em seu prefácio que, apesar de acreditar que é altamente provável que tudo o que o livro afirma seja verdadeiro, também é altamente provável que o livro contenha, pelo menos, algum erro – parece não ter sido explorado o suficiente pelos contextualistas. Portanto, pretendemos sugerir uma versão do paradoxo do prefácio apresentando um argumento análogo ao argumento que os contextualistas costumam apresentar para explicar o paradoxo cético. Desta maneira, pretendemos oferecer, por meio de uma análise contextualista, uma explicação para o paradoxo do prefácio. Se a resposta contextualista é ou não adequada para esse paradoxo, isso será questão de disputa e não nos caberá discuti-la aqui. This is an introductory handbook for some of the main themes around the notion of predication in Aristotle. It does not aim at being exhaustive, but only sketches some important lines about the subject; it contains an introductory essay, besides the translation (into Portuguese) and commentary of basic texts (such as Posterior Analytics I-22, Categories 1-5, Interpretation 1-6 etc.).

ABSTRACTLinguistic evidence supports the claim that certain, weak rejections are less specific than assertions. On the basis of this evidence, it has been argued that rejected sentences cannot be premisses and conclusions in inferences. We give examples of inferences with weakly rejected sentences as premisses and conclusions. We then propose a logic of weak rejection which accounts for the relevant phenomena and is motivated by principles of coherence in dialogue. We give a semantics for which this logic is sound and (...) complete, show that it axiomatizes the modal logic KD45 and prove that it still derives classical logic on its asserted fragment. Finally, we defend previous logics of strong rejection as being about the linguistically preferred interpretations of weak rejections. (shrink)

This book discusses Aristotle’s notions of essence and substance as they are developed in Metaphysics ZH. I examine Aristotle's argument at length and defends an unorthodox interpretation according to which his motivation is to provide an answer against a conflation between criteria for existential priority (delivering substances as primary beings) and criteria for explanatory priority (delivering essences as primary principles).

I discuss in this paper the six requirements Aristotle advances at Posterior Analytics A-2, 71b20-33, for the premisses of a scientific demonstration. I argue that the six requirements give no support for an intepretation in terms of “axiomatization”. Quite on the contrary, the six requirements can be consistently understood in a very different picture, according to which the most basic feature of a scientific demonstration is to explain a given proposition by its appropriate cause.

I examine Aristotle’s definition of scientific knowledge in Posterior Analytics 71b 9-12 and try to understand how it relates to the sophistical way of knowing and to "kata sumbebekos knowledge". I claim that scientific knowledge of p requires knowing p by its appropriate cause, and that this appropriate cause is a universal (katholou) in the restricted sense Aristotle proposes in 73b 26-27 ff., i.e., an attribute coextensive with the subject (an extensional feature) and predicated of the subject in itself (an (...) intensional feature). Kata sumbebekos knowledge, on the other hand, can occur even when the predicate of a conclusion is coextensive with its subject and is proved by a convertible meson which is not the most appropriate from an explanatory standpoint. In this paper, I argue against the popular philosophical thesis---aka the ‘own action condition’---that an agent can only intend one’s own actions. I argue that the own action condition does not hold for any executive attitude, intentions included. The proper object of intentions is propositional rather than agential (‘I intend that so-and-so be the case’ rather than ‘I intend to do such-and-such’). I show that, although there are some essential de se components in intending, they do not restrict the content (...) of intentions to one’s own actions. I then discuss the special way in which one’s own actions can figure in the content of one’s intentions, which shows that the distinction between intending and acting is less stark than it appears at first. This is a conclusion that many defenders of the own action condition might find appealing but which, I argue, is better supported by rejecting the own action condition. (shrink)

In Posterior Analytics 71b9 12, we find Aristotle’s definition of scientific knowledge. The definiens is taken to have only two informative parts: scientific knowledge must be knowledge of the cause and its object must be necessary. However, there is also a contrast between the definiendum and a sophistic way of knowing, which is marked by the expression “kata sumbebekos”. Not much attention has been paid to this contrast. In this paper, I discuss Aristotle’s definition paying due attention to this contrast (...) and to the way it interacts with the two conditions presented in the definiens. I claim that the “necessity” condition ammounts to explanatory appropriateness of the cause. (shrink)

According to Jim Pryor’s dogmatism, when you have an experience with content p, you often have prima facie justification for believing p that doesn’t rest on your independent justification for believing any proposition. Although dogmatism has an intuitive appeal and seems to have an antisceptical bite, it has been targeted by various objections. This paper principally aims to answer the objections by Roger White according to which dogmatism is inconsistent with the Bayesian account of how evidence affects our rational credences. (...) If this were true, the rational acceptability of dogmatism would be seriously questionable. I respond that these objections don’t get off the ground because they assume that our experiences and our introspective beliefs that we have experiences have the same evidential force, whereas the dogmatist is uncommitted to this assumption. I also consider the question whether dogmatism has an antisceptical bite. I suggest that the answer turns on whether or not the Bayesian can determine the priors of hypotheses and conjectures on the grounds of their extra-empirical virtues. If the Bayesian can do so, the thesis that dogmatism has an antisceptical bite is probably false. (shrink)

I discuss three kinds of relationship between ends and means (or "things that promote ends") in the Aristotelian ethical theory, in order to clarify how moral virtues and phronesis are related both in adopting ends and in determining means for virtuous actions. Phronesis seems to be mainly charged with determining means for an end given by the moral virtues, but it must involve some conception of ends too. Phronesis cannot be parasitic on moral virtue concerning the conception of ends, for (...) otherwise it will lack intrinsic moral value. I argue that the intrinsic moral value of phronesis can be better understood through a certain kind of relation between means and ends that has not received much attention. (shrink)

We present an inferentialist account of the epistemic modal operator might. Our starting point is the bilateralist programme. A bilateralist explains the operator not in terms of the speech act of rejection ; we explain the operator might in terms of weak assertion, a speech act whose existence we argue for on the basis of linguistic evidence. We show that our account of might provides a solution to certain well-known puzzles about the semantics of modal vocabulary whilst retaining classical logic. (...) My object is Aristotle's discussion of principle of non-contradiction in the first stretch of Metaphysics IV.4. My main focus rests on the connections between Aristotle's discussion of the principle and some key notions of his (explicit or implied) semantics.

I discuss some of Aristotle’s scattered remarks from which one can construct his conception of matter. Aristotle seems to oscillate between two conceptions: one in which matter is the principle of becoming, another in which matter is a constituent element with no contribution for processes of becoming. Sometimes Aristotle takes matter as a thing independent in itself, and the correlated form is a feature that does not contribute to the matter’s essence, nor is a necessary condition for its existence. But (...) sometimes Aristotle takes matter as a constituent element the existence of which depends on the whole thing it is the matter of. These different approaches to matter seem to suggest an inconsistent theory of matter. However, I argue that, quite to the contrary, Aristotle has a consistent theory about matter. One of my main points is to distinguish contexts in which Aristotle is indeed talking about matter in general from contexts in which he uses the term “matter” to refer to a given thing that was previously taken as matter and to talk about that thing not qua matter, but qua the thing it is. This paper introduces the Monstrous Conclusion, according to which, for any population, there is a better population consisting of just one individual (the Monster). The Monstrous Conclusion is deeply counterintuitive. I defend a version of Prioritarianism as a particularly promising population axiology that does not imply the Monstrous Conclusion. According to this version of Prioritarianism, which I call Asymptotic Prioritarianism, there is diminishing marginal moral importance of individual welfare that can get close to, but never quite reach, some upper limit. (...) I argue that Asymptotic Prioritarianism faces a theoretical cost, that I call the Absolute Priority Principle. However, the Absolute Priority Principle is an extreme version of what I call the Trade-off Condition, an already noteworthy problem facing other (more widely endorsed) versions of Prioritarianism. I conclude that it is better for a theory to imply the Absolute Priority Principle and avoid the Monstrous Conclusion than to imply the Monstrous Conclusion and the Trade-off Condition. The potential for Asymptotic Prioritarianism is substantial. (shrink)

In response, Explainable AI (XAI) has emerged as a field of research with practical and ethical benefits across various domains. This paper not only highlights the advancements in XAI and its application in real-world scenarios but also addresses the ongoing challenges within XAI, emphasizing the need for broader perspectives and collaborative efforts. We bring together experts from diverse (...) fields to identify open problems, striving to synchronize research agendas and accelerate XAI in practical applications. By fostering collaborative discussion and interdisciplinary cooperation, we aim to propel XAI forward, contributing to its continued success. Our goal is to put forward a comprehensive proposal for advancing XAI. To achieve this goal, we present a manifesto of 27 open problems categorized into nine categories. These challenges encapsulate the complexities and nuances of XAI and offer a road map for future research. For each problem, we provide promising research directions in the hope of harnessing the collective intelligence of interested stakeholders. (shrink)

This paper examines Aristotle’s notion of priority with the specific aim of capturing the sort of priority that characterizes the primacy of substances in his metaphysics. I reject the traditional interpretation, which understands the ontological priority of substances in terms of independent existence. But there are rather two sorts of priority: the ontological priority of substances should be understood in terms of completeness, whereas the ontological priority of “substances-of-something” (the essences) is a causal-explanatory priority. Furthermore, an important piece of Aristotle’s (...) argument against Platonism is that these two sorts of priority – namely, the completeness priority and the causal-explanatory priority – should be kept distinct. Constitutivism argues that the source of the categorical force of the norms of rationality and morality lies in the constitutive features of agency. A systematic failure to be guided by these norms would amount to a loss or lack of agency. Since we cannot but be agents, we cannot but be unconditionally guided by these norms. The constitutivist strategy has been challenged by David Enoch. He argues that our participation in agency is optional and thus cannot be a source of (...) categorical demands. In this paper, I defend the viability of constitutivism by showing that agency is indeed a special ‘inescapable’ enterprise. Agency has the largest jurisdiction, and it is closed under rational assessment. This inescapability does not exempt constitutivism from raising the question whether agents have reason to be agents, but this question has to be taken up within agency. If this question is answered affirmatively, then—I argue—the criteria of practical correctness are self-ratifying in a non-circular way. This is sufficient to show the viability of the constitutivist strategy. Whether agents have conclusive reasons to be agents, however, is a matter to be addressed in the terms of particular versions of constitutivism. (shrink)

In this paper I investigate whether there are genuine and irreducible pressures of diachronic rationality grounded on the structure of the subject rather than on substantive considerations, such as pragmatic ones. I argue that structural pressures of diachronic rationality have a limited scope. The most important pressure only tells against arbitrary interference with the mechanisms for the retention of attitudes over time. I then argue that in the practical case, a substantial account in terms of the agent's temporal identity appears (...) more promising than a purely structural one, but in the end it still leaves many questions about diachronic practical rationality underdetermined. Pictures are created objects that have the function of generating a perceptual experience. In this sense, they are “experiential artifacts” (Terrone forthcoming). The experience elicited by pictures – usually visual (but for non-visual pictorial experience see e.g. Lopes 1997) – is a composite perceptual experience, in which the “perception” of the depicted scene (which is not in front of us) is generated by and experienced along the perception of the marked surface (the object that is actually in front of us). (...) This experience is usually called a “pictorial experience”. A philosophical analysis of such an experience amounts to answering the following questions: How should we describe the phenomenology of pictorial experience? What is it like to experience pictures? How should the “perception” of the depicted scene be characterized? Is it really a form of perception? How does it relate to the perception of the marked surface? (shrink)

The translation, which was made at 2004, is preliminary and its publication was intended to provide a didactic tool for courses as well as a provisional resource in research seminars. It needs some revision. I am currently working (slowly...) on the revision of the translation and a new revised one will surely appear at some point.

Commentary on Aristotle's Metaphysics Lambda. It accompanies the translation of Aristotle's Metaphysics Lambda into Portuguese in the same volume of the journal.

According to Originalism, word types are non-eternal continuants which are individuated by their causal-historical lineage and have a unique possible time of origination. This view collides with the intuition that individual words can be added to the lexicon of a language at different times, and generates other problematic consequences. The paper shows that such undesired results can be accommodated without abandoning Originalism.

This paper is my first effort to revaluate the disagreement between two central texts for Aristotle's the conception of ousia: Categories and Metaphysics VII. Scholars have taken chapter Zeta-3 as a payment of the debt with the Categories, so that the hylomorphic analysis of the composite substance would require a revision of the subject-criterion, now improved by the addition of the “a this” and “separate” criterion. This paper, however, downgrades the importance of the Categories for understanding Aristotle's Metaphysics Z. The (...) two texts are dealing with different arguments and are not incompatible with one another. I myself consider this paper somehow obsolete, for I have returned to the same subject more than once: in my 2003 paper on Z-3 and, most importantly, on my Book 'As Noções Aristotélicas de Substância e Essência' (2008). I discuss the methodological passage in the begin- ning of Ethica Eudemia I.6 (1216b26-35), which has received attention in connection with Aristotle’s notion of dialectic and his methodology in Ethics. My central focus is not to discuss whether Aristotle is prescribing and using what has been called the method of endoxa. I will focus on how this passage coheres with the remaining parts of the same chapter, which also are advancing methodological remarks. My claim is that the meth- od of (...) Ethica Eudemia I.6 is in agreement with many features of Aristotle’s theory of explanation as presented in the Posterior Analytics: Aristotle’s main concern is a warning against misuses of explanatory arguments. Background: Despite being often taken as the benchmark of quality for diagnostic and classificatory tools, 'validity' is admitted as a poorly worked out notion in psychiatric nosology. Objective: Here we aim at presenting a view that we believe to do better justice to the significance of the notion of validity, as well as at explaining away some misconceptions and inappropriate expectations regarding this attribute in the aforementioned context. Method: The notion of validity is addressed taking into account its role, the (...) framework according to which it should be assessed and the specific contents to which it refers within psychiatric nosology. Results and Conclusions: The notion of validity has an epistemological thrust and its foremost role is distinguishing correct reasoning and truth from what is irrational or false. From it follows not only that 'validity' always refers to elements of knowledge and rationality such as arguments, inferences and propositions, but also that the appropriate frameworks to assess 'validity' are logics and scientific methodology. When the validity of a psychiatric diagnostic category is at stake, the contents to which it refers are those relevantly related to the notion of 'diagnostic concept'. The consequences of our reading on the notion of 'validity' are discussed vis-à-vis the challenges faced by psychiatric nosology in order to have its diagnostic categories validated. (shrink)

I argue that Topics VI does not contain any serious theory about definitions, but only a collection of advices for formulating definitions in a dialectical context, namely, definitions aiming to catch what the opponent means. Topics VI is full of inconsistencies that can be explained away by this approach: the inconsistencies reflect "acceptable opinions about definitions" that distinct groups of interlocutors accept. I also argue that the "topoi" need not be pieces of serious theory Aristotle is commited to. The "topoi" (...) must also be considered as "endoxa", namely, as accepted opinions about how it is legitimate to draw an inference. (shrink)

I discuss what Aristotle means when he say that scientific demonstration must proceed from necessary principles. I argue that, for Aristotle, scientific demonstration should not be reduced to sound deduction with necessary premises. Scientific demonstration ultimately depends on the fully appropriate explanatory factor for a given explanandum. This explanatory factor is what makes the explanandum what it is. Consequently, this factor is also unique. When Aristotle says that demonstration must proceed from necessary principles, he means that each demonstration requires the (...) principle that is the necessary one for the fully appropriate explanation of its explanandum. This picture also provides a key to understand Aristotle's thesis that scientific explanation depends on essences: it is the essence of the attribute to be explained that should be stated as the fully appropriate explanatory factor. At some point in the Incessu Animalium, Aristotle appeals to some geometrical claims in order to explain why animal progression necessarily involves the bending (of the limbs), and this appeal to geometrical claims might be taking as violating the recommendation to avoid “kind-crossing” (as found in the Posterior Analytic). But a very unclear notion of kind-crossing has been assumed in most debates. I will argue that kind-crossing in the Posterior Analytics does not mean any employment of premises from a discipline (...) other than that to which the explanandum belongs. Kind-crossing was meant to cover a specific sort of employment of premises from a different discipline, namely, the case in which premises from a discipline X are taken as the most important explanatory factor that delivers the fullest appropriate explanation of an explanandum within discipline Y. If this is so, the employment of geometrical premises in the Incessu Animalium is not an instance of the prohibited kind-crossing, but something that is in line with the theory of the Posterior Analytics. I review recent work on Phenomenal Conservatism, the position introduced by Michael Huemer according to which if it seems that P to a subject S, in the absence of defeaters S has thereby some degree of justification for believing P.

I have two aims in this paper. First, I argue that, in Aristotle’s theory of the four causes, there is a basic and common feature by which all causes are causes: they all work in a triadic framework in which they explain why a given attribute holds of a given underlying thing. Secondly, I argue against a version of “compatibilism” according to which each kind of cause is complete in its own domain and does not compete with any other kind. (...) I claim that there are priority relations according to which some kinds of cause are subordinated to others, even if these relations do not hold in every cases. (shrink)

According to the perceptual view of language comprehension, listeners typically recover high-level linguistic properties such as utterance meaning without inferential work. The perceptual view is subject to the Objection from Context: since utterance meaning is massively context-sensitive, and context-sensitivity requires cognitive inference, the perceptual view is false. In recent work, Berit Brogaard provides a challenging reply to this objection. She argues that in language comprehension context-sensitivity is typically exercised not through inferences, but rather through top-down perceptual modulations or perceptual learning. (...) This paper provides a complete formulation of the Objection from Context and evaluates Brogaards reply to it. Drawing on conceptual considerations and empirical examples, we argue that the exercise of context-sensitivity in language comprehension does, in fact, typically involve inference. (shrink)

Resumo: Neste artigo, apresentamos uma versão de uma teoria que eu chamarei de Contextualismo Epistêmico ‒ a visão de que o contexto e os padrões determinados por ele desempenham um papel central na avaliação de se um agente epistêmico tem, ou não, justificação e, portanto, conhecimento ‒ para tentar resolver um dos problemas mais influentes em epistemologia, a saber, o Problema do Regresso epistêmico. O primeiro passo será o de caracterizar o problema do regresso epistêmico. Em seguida, apresentaremos uma importante (...) distinção que é útil para um melhor entendimento da nossa tese, isto é, a distinção entre justificação proposicional e doxástica. Então, abordaremos as visões tradicionais que supostamente alegam resolver este problema, mostrando que todas são problemáticas. Por fim, apresentaremos a visão que pretendemos defender, mostrando como ela pode oferecer uma resposta ao problema do regresso epistêmico, de uma maneira que as outras visões não podem. Palavras-chave: Regresso Epistêmico, Justificação, Conhecimento, Contextualismo Epistêmico. Abstract: In this paper we present a version of a theory that we will call Epistemic Contextualism - the view that the context and the standards that it determines, play a central role in evaluating whether, or not, a subject has justification, and therefore knowledge - to try to solve one of the most influential problems in epistemology, namely, the Epistemic Regress Problem. The first step will be to characterize the epistemic regress problem. Next, we present an important distinction that is useful to a better understanding of our view, that is, the distinction between propositional and doxastic justification. Then, we present traditional views that allegedly claim to solve this problem showing that all are problematic. The final step concerns the exposition of the view we want to defend, showing how it can solve the epistemic regress problem in a way that the other views cannot. Translation of Aristotle's Metaphysics IV and VI, with notes. The translation is preliminary and intended as a provisional teaching tool to be also used in seminars and discussions with peers in order to reach a more elaborated version.

I discuss Aristotle's treatment of essence and definition in Metaphysics VII.4. I argue that it is coherent and perfectly in accord with its broader context. His discussion in VII.4 offers, on the one hand, minimal criteria for what counts as definition and essence for whatever kind of object, but also, on the other hand, stronger criteria for a primary sort of definition and essence—and thereby it serves the interest of book VII in pointing to the explanatory power of the essence (...) of composite substances.
